Step 1: Filing the Trademark Application

Step 2: Examination, Acceptance, and Publication in the Trademark Journal

This stage generally begins approximately three months after the application is submitted.

During this phase, the trademark application is examined in accordance with Sections 6, 8, and 10 of the Trademark Act, 2009. The authorities review the application to determine whether the proposed trademark is distinctive and whether any identical or confusingly similar trademark has already been registered or applied for by another party.

If an identical or substantially similar trademark already exists, the application may be refused.

Once the examination is successfully completed and the trademark is accepted, the applicant may proceed with the necessary formalities for publication in the Trademark Journal (Gazette). The required publication fees must be paid, and the trademark will be published for public notice.

Step 3: Registration Certificate Issuance

After publication in the Trademark Journal, a specified opposition period is provided for third parties to raise objections against the registration.

If no opposition is filed, or if any opposition proceedings are resolved in favor of the applicant, the trademark will be officially entered into the Trademark Register.

Upon successful registration, the applicant will receive an official Trademark Registration Certificate confirming ownership and legal rights over the mark.

Validity and Renewal

The initial registration remains valid for seven (7) years from the date of application.

After the initial term, the trademark may be renewed every ten (10) years indefinitely, provided the applicable renewal requirements and fees are fulfilled.
